TINJAUAN YURIDIS PENEGAKAN HUKUM TERHADAP PELAKU JUDI ONLINE DI WILAYAH KEPOLISIAN SUMATERA UTARA
Abstrak
he development of information technology has brought significant impacts to various aspects of human life, including the emergence of new forms of crime in the form of online gambling. This phenomenon has become a serious concern for law enforcement authorities, particularly within the jurisdiction of the North Sumatra Regional Police (Polda Sumatera Utara), considering the increasing prevalence of online gambling practices that are difficult to monitor and have caused social unrest. This study aims to examine the implementation of law enforcement against online gambling offenders within the jurisdiction of the North Sumatra Regional Police and to analyze the factors that hinder and support the law enforcement process.
This study employs an empirical juridical research method by combining primary data obtained through interviews with officers of the North Sumatra Regional Police and secondary data derived from statutory regulations, legal literature, and court decisions related to online gambling offenses.
The results of the study indicate that law enforcement against online gambling offenders has been carried out through the application of Article 27 paragraph (2) in conjunction with Article 45 paragraph (2) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 on Electronic Information and Transactions, as well as Article 303 of the Indonesian Criminal Code concerning gambling. However, the law enforcement process continues to face several obstacles, including limited human resources and technological capabilities, difficulties in tracing servers located overseas, and the low level of public legal awareness.
This study concludes that law enforcement against online gambling offenders within the jurisdiction of the North Sumatra Regional Police has been implemented but has not yet reached an optimal level. Therefore, it is necessary to strengthen the capacity of law enforcement officers, enhance inter-agency and international cooperation, and improve legal awareness programs for the public in order to minimize online gambling crimes in the future.
